Payment for a design service does not automatically constitute the transfer of ownership of every underlying working file, unused concept or development asset.
Where ownership or copyright is intended to be transferred to a client, such transfer must be specifically agreed upon in writing.
W.D.Designz & Marketing reserves the right to retain copies of completed work for portfolio, promotional and business record purposes unless otherwise agreed in writing.
Client-Supplied Material
Clients are responsible for ensuring that they have the necessary rights, licences and permissions to provide images, logos, text, photographs, videos, documents, trademarks or other material supplied to W.D.Designz & Marketing.
The client warrants that the material supplied does not knowingly infringe the intellectual property, copyright, trademark, privacy or other rights of any third party.
W.D.Designz & Marketing will not be responsible for claims arising from material supplied by the client where the client did not have the necessary rights or permissions to use that material.
Client Approval & Revisions
Clients are responsible for reviewing and approving designs, content, websites and other creative work before publication, printing or implementation.
Where a client requests amendments, revisions will be completed in accordance with the agreed project scope.
Additional work outside the agreed scope may be charged separately.
Once a design, website, document or other creative project has been approved by the client and supplied as a completed final version, subsequent alterations or additional work may constitute a new chargeable service.
Quotes, Payments & Project Fees
All services are subject to the applicable quotation, proposal or agreed project fee.
Unless otherwise agreed:
- Work will commence once the required deposit or payment has been received.
- The balance of the project fee becomes payable upon completion or according to the agreed payment schedule.
- Additional work outside the original scope may be quoted separately.
- Delayed client feedback or failure to supply required information may affect project completion times.
- Ownership or usage rights relating to creative work may be subject to full payment of the applicable invoice.
All quotations are subject to the validity period stated on the quotation.
Cancellation & Refund Policy
Because W.D.Designz & Marketing provides professional services involving time, expertise, planning, creative development and resources, payments made for work that has already commenced are generally non-refundable.
Once work has commenced, fees may cover time already spent on:
- Consultation
- Research
- Planning
- Design
- Development
- Content creation
- Revisions
- Project management
- Technical implementation
Cancellation of a project after work has commenced does not automatically entitle the client to a refund.
Where a project is cancelled, any outstanding fees relating to work completed up to the date of cancellation remain payable.
Any refund considered by W.D.Designz & Marketing will be assessed on a case-by-case basis and remains at the discretion of W.D.Designz & Marketing.
Where a refund is voluntarily provided as a goodwill gesture, this does not constitute an admission of liability, fault or failure to provide the agreed service.
Use of Completed Work
A client may use completed and fully paid-for work for the purpose for which it was originally commissioned.
However, clients may not knowingly reproduce, resell, redistribute or provide W.D.Designz & Marketing’s original creative work to another designer, agency or third party for substantial modification or redevelopment where doing so would infringe W.D.Designz & Marketing’s retained intellectual property rights.
Any transfer of source files or editable working files must be specifically agreed upon.
Limitation of Liability
W.D.Designz & Marketing shall not be liable for any indirect, incidental, consequential or financial loss arising from the use of our website, services, recommendations, digital platforms or third-party services.
This includes, where applicable:
